ARBITRATION
AANE uses NAAA rules and regulations. It is recommended that all new customers familiarize themselves with the arbitration policy. For an updated copy of the arbitration rules, please visit https://naaa.com/Policy/policy.html.
POST-SALE INSPECTIONS
Although it is not required, AANE strongly suggests that all online purchases that qualify, receive a post-sale inspection. It is the Buyers responsibility to notify the AANE Service Department at (603) 437-5700 Ext. 532 on all online purchases that buyers would like to have post-sale inspected. TIE BIDS
Floor bidders will have preference in the case of a tie.
PAYMENT
All printable online sale receipts are for customer convenience only. AANE does not guarantee the accuracy of any sale receipt that has been printed from the internet. In a matter of discrepancy, all charges that are within the AANE Auction Management System will be considered the correct sale price and fees. AANE must receive payment by noon on the subsequent day after any sale or a $100 per day late fee will be applied. We accept wire transfer, approved floor plan, and bank check. PURCHASED VEHICLES
Your purchased vehicles are subject to being moved after 3 business days and may be charged storage fees depending on the length of time the vehicle(s) have been left on property.
PASSWORD RESPONSIBILITY
You are solely and entirely responsible for maintaining the confidentiality of your password. Furthermore, you are solely and entirely responsible for any and all activities, which occur, under your account. You agree to immediately notify AANE of any unauthorized use of your account or any other breach of security known to you. You acknowledge that the complete privacy of your data and messages transmitted while using the Service cannot be guaranteed.

AUTO AUCTION OF NEW ENGLAND GENERAL AUCTION POLICIES
Effective April 3, 2023
BUYERS AND SELLERS
1. Only Dealers, 18 years and older, complying with the motor vehicle regulations of their state may
attend this auction. All new Dealers must register in the office before buying and selling. Photo
identification cards are required on auction property at all times. It is the sole responsibility of the
licensee to return I.D. cards to the Auction when an agent is no longer authorized.
2. Bidder badges are required for both buyer and seller on day of sale and must be worn on the outermost
garment at all times. Dealers will be asked to present badges for entry and during sale. Pictures of
badges is strictly prohibited.
3. The licensed and registered Dealer is responsible for all business transacted under that company name
at AUTO AUCTION OF NEW ENGLAND, INC. All changes of ownership, authorized
representatives, banking facilities, address and telephone number(s) must be reported to the Auction at
time of change.
4. All purchases and sales of vehicles on AUTO AUCTION OF NEW ENGLAND, INC.’S premises
must be reported and transferred through the office. Any deviation may result in termination of auction
privileges.
5. All sales are final after 5pm day of sale except as noted below:
Unannounced structural damage, structural repair, salvage, engine change, flood vehicles, branded
titles, vehicles in Post Sale Inspection or unannounced TA.
6. NO RETAIL CUSTOMERS OR VISITORS ALLOWED. This auction is for licensed and registered
dealers only. All Dealer drivers and mechanics must have a drivers badge and carry a dealer’s plate
and are restricted to the front office or cafeteria. All drivers must have a gate pass to gain access to the
auction yard. All other unauthorized persons are not allowed on auction premises. Any violations of
these policies will result in temporary or permanent revocation of all trading privileges. No children
please.
7. AUTO AUCTION OF NEW ENGLAND, INC. does not guarantee or assume responsibility for the
accuracy of odometer readings.
8. Buyers and Sellers agree to indemnify and hold harmless AUTO AUCTION OF NEW ENGLAND,
INC. from any claim made against it or arising from transactions at this auction.
9. AUTO AUCTION OF NEW ENGLAND, INC. assumes no responsibility for verbal commitments or
personal green lights. Verbal commitments or personal green lights are not subject to arbitration or
post sale inspections. The seller will be responsible for any mechanical diagnosis fees on these
vehicles. Should the sale be voided, the seller will be responsible for the buy and sell fees.
10. All sales cancelled by mutual agreement must be reported to the office. All buyer and seller fees will
be the responsibility of the Seller.
11. Any accepted price adjustment automatically makes the transaction “AS IS.”
12. The Consignor/Buyer, as the case may be, bears all risk of loss or damage from fire, theft vandalism or
any cause whatsoever. Under NO circumstances shall AUTO AUCTION OF NEW ENGLAND, INC.
have any liability for any such loss or damage.
13. Whereas ownership of the vehicle or its accessories is never transferred to AUTO AUCTION OF
NEW ENGLAND, INC., the auction does not assume responsibility for any theft, fire or vandalism.
The titled owner of the stolen property must make a claim to his/her insurance company. Any vehicle
and/or personal property left on the premises is done so at the owner’s risk.
14. AUTO AUCTION OF NEW ENGLAND, INC. reserves the right to hold any and all vehicles within
its possession from any and all Buyers and Sellers in which to satisfy any and all debts and/or claims
which AUTO AUCTION OF NEW ENGLAND, INC. may have upon said Seller or Buyer.
15. All vehicles must have a gate pass before being removed from AUTO AUCTION OF NEW
ENGLAND, INC’S premises.
16. AUTO AUCTION OF NEW ENGLAND, INC. does not guarantee the year, make, model, trim or
mileage of any motor homes, travel trailers, boats, boat motors, motorcycles, antiques, ATV’s, jet
ski’s, watercrafts or any other specialty/recreational vehicles.
17. A service fee of $100 will be charged for all returned checks.
18. IF SALES: all units sold with an “IF” must be resolved in TWO hours or Buyer can void the sale.
Buyer is responsible to check on the status of an “IF” bid and is required to purchase car(s) if the bid is
accepted in less than two hours. Buyer must initiate voiding sale at or after the two hours.
Sellers/Buyers must respond to any counter offers within two hours.
19. All vehicles will be run through AutoChecks' verification system on day of sale only. AUTO
AUCTION OF NEW ENGLAND, INC. does not assume responsibility for any changes to the data
after the sale.
20. The use of videography and/or photography is strictly prohibited on auction premises.
21. AUTO AUCTION OF NEW ENGLAND, INC auction policies will override certain NAAA
guidelines.
22. AUTO AUCTION OF NEW ENGLAND, INC reserves the right to cancel any sale for any reason
deemed necessary.
23. AUTO AUCTION OF NEW ENGLAND, INC reserves the right to accept or reject new dealer
applications. AUTO AUCTION OF NEW ENGLAND, INC may revoke existing dealer’s privileges to
conduct business for any reason deemed necessary.
SELLER
1. Information written on the windshield is provided as a courtesy service. The Seller is responsible for
verifying the accuracy of the year, make, model, trim and mileage. The Seller is also responsible for
verifying the accuracy of the announced conditions and the condition light on the vehicle they are
offering for sale.
2. No vehicle will be offered for sale without a serial number plate on the dashboard and a second point
of I.D. The auction reserves the right to refuse the sale of any vehicle on which the vehicle
identification plate appears marred or in any way altered.
3. Over 100,000 miles, unknown mileage (TMU), not actual mileage (NAM) vehicles must be
announced. TMU and NAM vehicles with over 100,000 miles must be announced and will be sold “AS
IS.” An inoperable odometer must be arbitrated within 7 business days.
4. Title should be submitted prior to sale, and must be submitted by 5pm on the day of sale. If the title is
not received by 5pm, an unannounced title attached fee will be charged and the Buyer has the right to
refuse the sale. If sale is cancelled, the Seller is responsible for all Buyer and Seller fees.
5. AUTO AUCTION OF NEW ENGLAND, INC. will not accept the following:
a. Canadian vehicles;
b. Any paperwork issued outside the United States;
c. Gray Market Vehicles;
d. Any title which does not have provision for odometer reading, or any title on which odometer
reading has been left open;
e. New Hampshire titles model year 1999 or older. Seller must meet requirements in #6.
f. Any title with any of the following defects:
- Alterations
- Erasures
- Improper reassignments
- Wrong digits
6. Seller must have one of the following for non-titled vehicles to be accepted:
a. valid registration signed over to dealer; or
b. copy of valid registration and notarized assignment from registered owner to dealer; or notarized
bill of sale from last registered owner to dealer
All non-titled/no paperwork vehicles must have the approval from auction management prior to being
sold. Once approved, the Seller must announce that vehicles are “Non-Titled.”
7. Massachusetts dealers cannot sell boats assigned to them without a Mass. boat dealer license.
8. All vehicles entered into Post Sale Inspection, regardless of timeframe, may be subject to extended
arbitration until inspection is completed.
BUYERS
1. All vehicles purchased at AUTO AUCTION OF NEW ENGLAND, INC. must be paid for on the day
purchased. $100/day late fee will be assessed on all unpaid vehicles.
2. All arbitration requests by the Buyer must be filed at the Arbitration Office and vehicle must be on
property by 5pm on day of sale.
3. No single mechanical defect under $800 will be arbitrated.
4. Visible defects and equipment are the responsibility of the buyer. Check inside and outside before
buying.
5. It is the Buyer’s responsibility to be aware of announcements and/or declarations of any vehicle being
sold.
6. Buyers who floorplan are responsible to check titles for any discrepancies.
7. All Vehicles sold for $3,000 or less are sold “AS IS” and can only be arbitrated for not announced TA
or no title. Buy them assuming they have over 100,000 miles, TMU, NAM, broken odometers,
structural damage, changed engines, branded titles, mileage exempt or all of the above. DO NOT GO
THROUGH ARBITRATION WITH VEHICLES SOLD FOR $3,000 OR LESS.
8. No Buyer or Buyer’s customer shall contact any Seller or Seller’s customer directly. All contact must
be handled by auction employees only.
9. Buyer must document any damage on the gate pass prior to removing the vehicle from the Auction.
Auction will not be responsible for any damage not identified on the gate pass once the vehicle is
removed from the location.
ARBITRATION
1. The Buying Dealer may request an arbitration by 5pm on day of sale. All adjustments are made in the
Arbitration Office. NO SINGLE MECHANICAL DEFECT UNDER $800 WILL BE ARBITRATED.
2. Not subject to arbitration: U-joints, bearing/hub assembly, all glass conditions or any other
maintenance/wearable items or characteristic sounds or functions the manufacturer claims acceptable.
3. Vehicles with a sale price of $3,000 or less are sold “AS IS” and can only be arbitrated for not
announced TA or no title.
4. Vehicles 15 years or older cannot be arbitrated for mileage discrepancies including TMU, NAM or
exempt.
5. All motor homes, travel trailers, boats, boat motors, motorcycles, antiques, reconstructed salvage
vehicles, ATV’s, jet ski’s and watercrafts or any other recreational vehicles will be sold “AS IS” and
not subject to arbitration.
6. Structural Damage. Unannounced structural damage, repaired or not, must be reported and returned to
AUTO AUCTION OF NEW ENGLAND, INC. within seven (7) days. Altered frames on non-factory
bodies, limousines, box trucks, plows and hitches are not grounds for rejection. Structural damage
from normal use (scratches, jack/lift marks, or contact with parking abutments) is not grounds for
arbitration. Damaged or repaired radiator/core support, minor frame horn damage are not grounds for
arbitration. Structural damage will be determined based upon NAAA’S structural policy. If necessary,
Auto Auction of New England, Inc. will have a vehicle measured at a facility of its choice. Buyer will
agree to pay for the measurement if the vehicle is within Used Vehicle Measurement Standard
(UVMS). Seller is responsible for all charges and fees if sale is cancelled.
7. All yard sales are “AS IS’ and can only be arbitrated for structural or flood damage, salvage,
reconstructed, theft, branded title, TMU, NAM, any title marked “void”, or non-titled vehicles unless
noted on the bill of sale.
8. Vehicle must be on AUTO AUCTION OF NEW ENGLAND, INC. property and available for
arbitration to inspect.
9. UNDER NO CIRCUMSTANCES DOES AUTO AUCTION OF NEW ENGLAND, INC. INHERIT A
VEHICLE.
10. AUTO AUCTION OF NEW ENGLAND, INC. encourages Sellers to properly represent vehicles. If it
is found the Seller is purposely misrepresenting vehicles, auction privileges may be revoked or
penalties may be assessed at Auction discretion.
11. IN MATTER OF INTERPRETATION OF AUCTION POLICY, THE DECISION OF
AUCTION MANAGEMENT WILL BE FINAL.
12. Vehicles with more than 500 miles on odometer then originally sold will not be considered for
arbitration.
13. Any transport reimbursements will need to be qualified by the Auction and limited to reasonable
wholesale rates. Rates will be based on the address of Buyer’s dealership location to and from address
of Auction location.
LIGHT SYSTEM
BLUE LIGHT – (TITLE ATTACHED)
Any Seller not having proper paperwork to transfer the title on the day of sale must announce “Title
Attached.” The title must be submitted to the Auction within 10 business days. Sale day is Day 1. The
buyer is advised not to sell or spend money on the vehicle until the title is received. In the event the title is
not received by the Auction within 10 business days, the Buyer may return the vehicle, only after
notification to Arbitration personnel. When Title Attached is announced a $50 fee will be assessed. When
Title Attached is not announced, a $150 fee will be assessed.
All Title Attached, transportation, Buyer and Seller fees will be the responsibility of the Seller if title is not
turned in within 10 business days.
GREEN LIGHT
Sold with a ‘Ride and Drive’ and is mechanically sound. No singular defect in the engine or driveline that
exceeds a $800 wholesale repair.
YELLOW LIGHT
The vehicles are sold subject to the following announced conditions or defects stated by the Seller and
noted on the Bill of Sale:
1. Salvage, Insurance, Reconstructed, Recovered Theft, Service Vehicles, Manufacturers Buyback,
Lemon Law or any other branded title;
Reconstructed/Rebuilt title announcement indicates the vehicle has been repaired, inspected and
can be registered.
Salvage title announcement indicates the vehicle has existing damage or has been repaired but not
inspected. Seller must provide appropriate paperwork under this announcement (i.e. estimate,
repair invoice, inspection slip).
2. Structural damage, repaired or not;
3. True Mileage Unknown or Not Actual Mileage, inoperable or replaced odometer and Exempt vehicles;
4. Mileage over 100,000; over 200,000, etc;
5. Flood vehicles;
6. Reassigned vehicle identification numbers;
7. Lack of, or altered federal standard safety and emission equipment;
8. Missing, incorrectly replaced air bags;
9. Non-Titled Vehicles;
10. Vermont titles assigned to an individual.
11. Engine change.
RED LIGHT “AS IS”
All vehicles sold “AS IS” are sold unconditional in terms of physical and mechanical defects. All vehicles
sold in excess of 100,000 miles or over 10 years of age are “AS IS”. The only required announcements for
“AS IS” vehicles over $3,000 are:
1. Structural damage, whether repaired or not.
2. Salvage, insurance, reconstructed, recovered theft, service vehicles, manufacturer buyback, lemon law
or any other branded title;
3. Titled Attached (TA);
4. True Mileage Unknown (TMU), Not Actual Mileage (NAM)
5. Over 100,000 miles; 200,000 etc.
6. Non-titled vehicle
RESERVED NUMBER SYSTEM
SEASON TICKETS
AUTO AUCTION OF NEW ENGLAND, INC. will reserve specific numbers to dealers on a long-term
basis. Season tickets are issued at the Dealers request and given the next available number(s). The season
ticket holders are required to fill their number(s) each week and cannot transfer or cancel. The AUTO
AUCTION OF NEW ENGLAND, INC. reserves the right to cancel or eliminate all season tickets
permanently based on activity and usage. Regular registration rates apply and are the responsibility of the
season ticket holder.
RESERVE NUMBERS
Reservations for the next Auction may be made during the sale each Auction Day beginning at 1:00 PM.
Reservations may be made either in person or by telephone.
Cancellation of numbers for current weeks’ sale must be made no later than noon on the day prior to the
Auction sale day. Failure to comply with this policy will result in the dealer being charged for the
registration fees on any unsold numbers.
STORAGE POLICY
1. There is a $10/day storage fee for all vehicles left at the auction after 3 business days from the last sale.
All vehicles left on property after 3 business days are subject to being transferred to an offsite location
where pickup is available only during normal business hours. To avoid storage fees, the vehicle must
either be removed within 3 business days or be transferred into the next sale.
2. Any vehicles left in the dealer parking lot, truck lot or front parking lot will be moved inside or
removed at owner’s expense, including key charges. Storage fees and transfer charges will be charged
immediately.
FUEL POLICY
There is a $5.00/gallon fuel charge for any vehicle needing gas. To avoid charges please bring your vehicle
with at least ¼ tank of gas.
PUSH POLICY
In order to have the lanes run safely and efficiently, vehicles will not be pushed through the auction lanes.
AUTO AUCTION OF NEW ENGLAND, INC. is not responsible for any damage resulting from pushing a
vehicle on property that is inoperable. See Auction Management for alternate sale procedures.
INTERNET SALES
All internet sales are subject to NAAA timelines. Post Sale Inspections are recommended for all
internet purchases. A $50 internet fee will be assessed for all vehicles purchased online.
POST SALE INSPECTIONS
Post Sale Inspections are available for anyone who purchases a vehicle that fits into the guidelines as
follows:
- Under 100,000 miles
- Sale price over $3,000
- Green Light
- Cannot be an Electric Vehicle, Specialty/Recreational, or Oversize unit.
